What is probate?
In a strict legal sense, probate is a document granted to the executor of an estate that gives them the legal authority to administer the estate. The process of receiving probate typically requires a probate court to determine the validity of a testator’s will. Objections or disputes about the validity of a will may result in probate litigation. Once probate has been granted, a will becomes legally binding, allowing the executor of the estate to enforce its terms through the administration of the estate, even in a court of law, if necessary.
